Rush (the band) Tells Rush (the pig person) to Cease and Desist

Rush (the band) have issued a Cease and Desist order to Rush Limbaugh (the pig person) and his producers ordering them to discontinue the use of any of their music in the Rush Limbaugh show.

Ladies & Gentlemen:

I am the attorney for Rush, their management company, S.R.O. Management Inc., their music publishing company, Core Music Publishing and their record company, The Anthem Entertainment Group Inc.

According to media reports, Rush Limbaugh, Premiere Radio Networks and The Rush Limbaugh Show have been using Rush’s recorded music as part of what is essentially a political broadcast.

The use of Rush’s music in this way is an infringement of Rush’s copyrights and trademarks. The public performance of Rush’s music is not licensed for political purposes and any such use is in breach of public performance licenses and constitutes copyright infringement. There are civil and criminal remedies for copyright infringement, including statutory damages and fines.

In addition, the use of Rush’s music in this manner implies an endorsement of the views expressed and products advertised on the show, and is in breach of not only copyright and trademark rights, but also, of section 51 of the New York Civil Rights Law (excerpt attached).

Accordingly, we hereby demand that you immediately stop all use of Rush’s music and confirm that you will do so.

        The fact that he has sobered women up to the misogyny endemic on the Right is another part of reality with which you should try to come to terms, one of far greater significance than whether or not Phil has the temerity to acknowledge the well-evidenced reality that Rush Limbaugh is a fat-ass PIG.

  4. I don’t know the particulars of Rush’s (the band’s) licensing arrangements. However, if Rush (The radio program) licensed the rights to the songs through ASCAP or BMI, which would hold the rights, there’s nothing the band can do but complain.

    Frankly, I suspect Rush (the Band) knows that, which explains why their “cease and desist” letter was sent to the media. If, however, Rush (the show) was using the songs without licensing them, it would be in the band’s interest to let him continue to do so and then sue him. Each instances of violation would subject Rush (the radio show) to additional damages.

      Peter Gabriel has also issued a C&D. I’m hoping that Chrissie Hind of the Pretenders does the same thing. That would take his theme song away…

      Sandra Fluke’s Congressional testimony pertained to how “the pill” is used to deal with gynecological medical conditions like endometriosis. It had nothing to do with her sex life or anyone else’s sex life.

Let’s not forget Limbaugh’s support for Joseph Kony, support which he offered based on little more than the fact that the name of Kony’s armed gang of hooligans had the word “Lord” in it (“Lord’s Resistance Army”). Well, that AND the all important, Obama Derangement Syndrome-fueled fact that President Obama, Kenyan Socialist Muslim that he is, had ordered United States special operations troops into Uganda to track Kony down and put an end to the rape, murder, kidnapping and sex slavery that Kony was employing to “protect” Christians from Muslims.

    While Limbaugh is, in fact, a sexist pig, he is also a racist, partisan PIG in the most generic sense, just an appalling human being who spews garbage day in and day out with little regard for the fact that his listeners believe and internalize his poisonous, hateful swill.

    As we appropriately go after him for the arrogant and reprehensible misogyny he displayed with respect to Sandra Fluke, and women, in general, recently, let us not, for an instant, forget the danger that Limbaugh has always posed, and will continue to pose as long as he is allowed to broadcast.

    Be sure to join the effort to get rid of Limbaugh once and for all by contacting his advertisers, as well as the company that employs him, Clear Channel, and complaining, by signing petitions being sent to his advertisers, to Clear Channel and the FCC, by contacting local radio stations broadcasting Limbaugh in your area and complaining about the content of his show, his comments regarding Sandra Fluke, in particular, and by complaining directly to the FCC.

It is also an epitaph of sorts for Flush, for conservatism/rightwingism/take-back-my-country-ism, as well, written by someone who was raised, and forced to listen to Limbaugh, by a father who listened to Flush religiously, and who, according to the author, was also a sociopath.
